California Used Car As Is Lawyer
What is an "As Is" warranty for a used car?
When you buy a used vehicle "as is", that means the dealer assumes zero responsibility for repairs or service, irrespective of any spoken statements about the car. That said, the seller cannot misrepresent the vehicle, lie about it, or hide key facts about its condition (such as whether or not it was a lemon repurchased by a manufacturer or a salvage vehicle). In other words, "as is" doesn't mean fraud is okay.
What other kinds of protections are available to used car buyers?
Implied warranties may provide you with some rights, such as warranty of merchantability – in other words, the product that you buy should be able to do what it's supposed to do. To demonstrate a breach of this implied warranty, a consumer must show that the vehicle was not of the same quality as cars that are generally acceptable in the trade or that the vehicle was not fit for ordinary purposes for which those types of vehicles are sold.
The implied warranty is time limited.
An implied warranty lasts one year or less.
If you suspect that the used car that you bought "as is" was defective and that the seller who sold you the car misrepresented or lied about its condition, what should you do?
