What does it mean to have a "lemon" motor home, according to California Law?

The Song-Beverly Act along with its subset provision, the Lemon Law, provides protection to consumers who buy motor homes. Specifically, it states that if a manufacturer or other warrantor fails to repair a new motor home to conform to the warranty after a reasonable number of attempts, the buyer can either return the unit for a refund or get a replacement vehicle.


Is the entire motor home covered under the Lemon Law?

No. The living quarters/coach are covered only by Song-Beverly because they are not technically considered a "new motor vehicle." However, you can still get a refund of your money if the unit does not conform to the warranty after a reasonable number of repair attempts.


Assuming that you make a reasonable number of attempts to repair the problem, and you are covered by the lemon law, will you get all of your cash refunded?

Yes, but you may have to pay what's known as a usage fee. This is calculated using the number of miles you drove the motor home prior to the first repair.

For instance, let's say that you drove the RV for 2,000 miles before noticing that the braking system was faulty.

To calculate your usage fee, you take that 2,000 miles, divide it by 120,000, and then multiply that number by the purchase price of the motor home. So, in this case, if your motor home cost $60,000, your usage fee would be calculated as follows:

Can you still seek remedies even if the California Lemon Law doesn't cover you?

Yes. As discussed above, the Song-Beverly Consumer Warranty Act does cover consumer products like the RV living quarters and coach. In addition, the California Consumer Legal Remedies Act gives you rights to recover your money if the seller misrepresented the home, lied to you, or failed to disclose important information, such as the fact that the vehicle had once been involved in a significant accident and got rebuilt.
