However, the California Lemon Law as it applies to motor homes can get quite confusing. Three different laws may or may apply:

  • The Song-Beverly Consumer Warranty Act
  • The Tanner Consumer Protection Act of California (a provision of Song-Beverly)
  • The California Consumer Legal Remedies Act

Song-Beverly Consumer Warranty Act

Song-Beverly offers consumers who purchase or lease new motor vehicles certain guarantees and protections. The law is applicable for the duration of your warranty, and it stipulates that if you have made a reasonable number of attempts to repair a damaged product (like the living quarters of a RV), the manufacturer may be required to either replace the vehicle or give you your money back.


Tanner Consumer Protection Act

The Tanner Consumer Protection Act – often referred to as the Lemon Law – specifically covers new motor vehicles. Included within this definition is both the chassis, chassis cab, and that portion of the motor home devoted to its propulsion.

Thus, you may seek remedies for a defective coach under both Song-Beverly or the California Lemon Law if there is a substantial problem that cannot be fixed after a reasonable number of attempts.


California Consumer Legal Remedies Act

On top of all of these protections, the California Consumer Legal Remedies Act further guarantees your rights. This law stipulates that, if a seller misled you, misrepresented the vehicle, or hid critical information from you (for instance, the fact that your RV was a manufacturer buyback – that is, someone else returned it as a lemon), you can get a refund of your money, reimbursement of your expenses, damages and attorney’s fees.
