Southern California Certified Arbitration Lawyer
What is certified arbitration?
It is a process to resolve disputes between manufacturers and consumers over warranties. Neutral arbitrators will oversee the process and render a decision.
Do you have to go through arbitration?
According to the California Lemon Law, you can skip arbitration. But there can be consequences if you opt out. If you have questions about whether arbitration is right for you, you can talk to the professionals here at The Law Offices of Howard D. Silver at 1-866-49-LEMON.
What are some of the advantages of certified arbitration?
- Arbitration is free.
- Once the program receives your application, you will get a decision within 40 days.
- You can observe the proceedings.
- You as a consumer can accept or reject the arbitration decision, but manufacturers are bound by the decision.
- If you reject what the arbitrators decide, you can still take your case to court.
What are some steps you should take if you believe that you have bought a lemon?
First of all, review your warranty information carefully. Work with your dealer and/or manufacturer to resolve the problem, if possible. Be sure to keep any correspondence with your manufacturer or any authorized service agency, and send correspondence via certified mail.
What requirements must you meet to pursue arbitration?
- The problem must be covered by the warranty the manufacturer issued you.
- You must notify the manufacturer directly about the defect or other problem.
- The problem you are having with a vehicle must "substantially impair" its use, value, or safety. If your radio is fuzzy, this won't be enough.
- The substantial problem has not been repaired satisfactorily.
- There is an arbitration program in place for the manufacturer.
- California State certified arbitration programs can be found at the Department of Consumer Affairs website.
